Remember war is the NEGATION of rights. When the aggressor starts a war they are throwing rights away (civil society) for violence and are now subject to the laws of the jungle. Criminals within a civil society still possess rights in the prosecution of force (because reason is still the epistemic goal) not so against an aggressor state. They regain rights when they surrender and embrace civil life again.
